The Energy Showdown Terms and Conditions. The official terms and conditions are listed below. In order to participate, you must read and agree to these terms by clicking the, "YES, I agree" link at the bottom.
INTRODUCTION: The 2010 SIREN Home Energy Showdown Contest (the “Contest”) is a program designed to encourage residential electricity consumers to reduce their electricity consumption. The goal of the Contest is to increase energy conservation awareness while providing participants with a chance to win prizes for saving on their electrical consumption (in accordance with the terms outlined herein). The electrical energy savings must (i) occur during the Contest Period, (ii) be in accordance with the Southern Indiana Renewable Energy Network (“SIREN”*) policies and procedures relating to how the savings is calculated and (iii) be determined using SIREN’s designed method for making such determination. The determination will be the percentage reduction electrical usage compared to the same time period from the previous year. Please read these rules carefully before entering. *A project under the Center for Sustainable Living, Inc., a 501c3 non profit organization Throughout these Official Rules, individual Participants in the Contest will be referred to as “you” or “Contestant”. SIREN will be referred to as “we” or “us”. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. YOU MUST BE AT LEAST 18 YEARS OF AGE OR OLDER AND A LEGAL RESIDENT OF THE UNITED STATES TO PARTICIPATE. THIS CONTEST IS VOID WHERE PROHIBITED.
CONTEST PERIOD: The Contest starts on January 1, 2010 at 12:00am Eastern Standard Time (“Contest Start Date”) and ends January 1, 2011 at 12:00a.m. Eastern Standard Time (“Contest End Date”). The period of time between the Contest Start Date and the Contest End Date is the “Contest Period.”
PRIZES:
One Grand Prize will be awarded to the Contestant with the
greatest percentage reduction in EEU for their Dwelling during
the Contest Period. The Grand Prize winner will be selected
from a group of 10 finalists chosen at the end of the 9 month
period, who have had the greatest reduction in EEU at that
time. The Grand Prize is a 1 kilowatt photovoltaic grid-tied
system, including photovoltaic panels, inverter, mounting
hardware, wiring, and balance of system items needed for
installation, including installation. The Grand Prize is
valued at $6,000. Every three (3) months after the Contest Start Date, a Quarterly Prize will be awarded to the Contestant with the greatest percentage reduction in EEU for that quarter-year period.
The
first Quarterly Prize is a Kill-a-Watt meter and solar site
assessment from Solar Systems of Indiana, prize valued at
$300. The second Quarterly Prize is a Blue-Line Power Cost
Monitor and whole house energy audit from Sherlock Homes,
prize valued at $720. The third Quarterly Prize is a Solio
solar charger and solar water heating site assessment from
Mann Plumbing, prize valued at $300. The fourth Quarterly
Prize is a Solar attic vent from Sunrise Solar valued at $600. Contestants who are absent from their Dwelling for more than fourteen (14) days during any three month period during the Contest Period are not eligible for the Grand Prize or any Quarterly Prize.
Any upgrades or changes made to the winning Contestant’s Dwelling as the result of winning the Grand Prize or any Quarterly Prize are subject only to the warranties of the manufacturer and of the installing contractor, if any. Neither SIREN, nor any of the program sponsors, make any representation nor extend any warranty for such upgrades or changes and the same are to be accepted by the winner “as-is” and without warranty. SIREN or any of the program sponsors make no representations or warranties of any kind concerning the appearance or performance of any enhancements added thereto.
Winning Contestants are solely responsible for all applicable taxes. Winning Contestants may be required to sign an IRS Form W-9 or the equivalent. No cash substitutions for prizes will be permitted and prizes are non-refundable and non-transferable except at sole discretion of SIREN. SIREN reserves the right to substitute prize of equal or greater value. Prize winning Contestants may forfeit their prizes if they cease being a customer of the Participating Utilities or cease to own or occupy their Dwelling prior to the end of the Contest Period.
SIREN reserves the right to make changes in the rules of this Contest including the substitution of a prize or prizes of equivalent value, which will become effective upon announcement. SIREN further reserves the right to cancel, terminate or modify this Contest if it is not capable of completion as planned, including, if caused by unauthorized intervention or technical failures of any sort.
At the judges’ sole discretion, entries deemed incomplete, invalid, illegible, unsuitable, obscene or indecent content or that are potentially in violation of third party rights (including, but not limited to, copyrights) will be immediately disqualified and SIREN will not be liable in any way for disqualified entries.
GENERAL: This Contest is subject to only to the laws of Indiana and the United States. Prizes will be awarded and/or delivered only to addresses in Monroe County, Indiana. No substitution of prizes is offered, no transfer of a prize to a third party is permitted, and non-cash prizes may not be redeemed for cash value. Prize winners will be solely responsible for all applicable federal, state and local taxes on prizes; winners will receive an IRS Form 1099 for the retail value of the prize. All other expenses on the receipt and use of the prize not specifically mentioned herein are the sole responsibility of the winner. Any portion of a prize not accepted by a winner will be forfeited and may be awarded to another contestant at the option of SIREN.
By entering the Contest, Entrants accept and agree to these rules and the decision of the judges, which shall be final. Finalists will be required to sign a Winner’s Affidavit and Liability/Publicity Release and return it by date specified in notification letter or Finalist status will be forfeited. By submitting an entry, a winner agrees to allow use of his or her name, photograph, likeness and biographical information for advertising and promotional purposes in any and all media (including online) without limitation as to time or territory and without additional compensation, except where prohibited. All entries will become the property of SIREN and will not be returned. Submission of an entry grants SIREN and its agents the right to publish, use, adapt, edit and/or modify such entry in any way, in any and all media, without limitation, and without consideration to the Entrant. Submission of any entry further constitutes the Contestant’s consent to irrevocably assign and transfer to Sponsor any and all rights, title and interest in the entry, including, without limitation, all copyrights.
OTHER CONDITIONS: SIREN assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Online entries generated by script, macro or other automated means will be disqualified. The determination of the percentage reduction in EEU will be based solely on information provided by the Participating Utility on their monthly billing statement. Any errors, inconsistencies, etc. in the information provided by the Participating Utility are not SIREN’s responsibility. Sponsor reserves the right in its sole discretion to cancel or suspend this Contest, in its entirety or in part, should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond SIREN’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. In the event SIREN cancels the promotion, prizes will be awarded by judging eligible entries received as of the time of such action. SIREN is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest by any technical or human errors which may occur in the processing of the entries in the Contest. By entering, Contestants agree to release the Promotional Parties and each of their respective officers, directors, employees and agents, from any and all liability, loss or damage incurred with respect to the on-site filming and energy audits, or the energy efficiency improvements implemented by Finalists. Entrants waive all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses. Entrants further agree that all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action. By entering, Entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of SIREN in connection with the Contest, shall be governed by, and construed in accordance with, the laws of State of Indiana, without giving effect to any choice of law or conflict of law rules. By entering, Entrants consent to the jurisdiction and venue of the federal, state, and local courts located in Monroe County, Indiana. SIREN reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the game or website or to be acting in violation of the Rules. CONDUCT: By entering this Contest, Entrants agree to be bound by these Official Rules and the decisions of SIREN shall be final and binding in all respects. These Official Rules will be posted on the SIREN website throughout the Contest Period. Failure to comply with these Official Rules may result in disqualification. SIREN reserves the right at its sole discretion to disqualify any Contestant found to be tampering with the entry process or the operation of the Contest or any electric meter; or to be acting in any manner deemed by SIREN to be in violation of the Official Rules; or to be acting in any manner deemed by SIREN to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person.
CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SIREN RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON UP TO THE FULLEST EXTENT PERMITTED BY LAW.
LIMITATIONS OF LIABILITY: SIREN assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Contest; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Contest; (d) inaccessibility or unavailability of the Internet or the website or any combination thereof, or; (e) any injury or damage to participants or to any other person's computer which may be related to or resulting from any attempt to participate in the Contest or download of any materials in the Contest. If, for any reason, the Contest is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, then SIREN reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest in whole or in part.
WINNER NOTIFICATION: Potential winners will be notified in person or by postal mail, email, or telephone based on the information provided on the contest entry form. The Grand Prize winner and Quarterly Prize winners will be required to sign and return a Memorandum of Agreement (MOA), including a Liability Release clause and a publicity release within seven (7) days of the date first written on the MOA. If any of the required documents are not returned within the required number of days, or if any mail (postal or email) is returned as undeliverable without a forwarding address, the prize may be forfeited and an alternate winner may be selected at SIREN's sole discretion. Any portion of a prize not accepted by a winner will be forfeited. Prize notification will only be delivered to an address within Monroe County, Indiana.
RELEASE: All entrants, as a condition of entry into and participation in, the Contest, agree to and do release SIREN and participating sponsors, from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting an entry or otherwise participating in any aspect of the Contest, the receipt, ownership or use of any prize awarded, or while preparing for, participating in or traveling to or from any prize-related activity, or for any typographical or other error in these Official Rules or the announcement of offering of any prize. Except for where prohibited by law, Entrants grant to SIREN the right to, and SIREN may print, publish, broadcast, and use worldwide in any media now known or hereinafter known (including without limitation use online) the Entrant’s name, address, voice, statement, picture or other likeness, without additional compensation, for public relations, advertising, and promotional purposes as may be determined by SIREN. Any Entrant who is also a winner of a prize agrees to sign a publicity release confirming such consent prior to acceptance of the prize. Entrant also agrees to hold SIREN harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.
DATA COLLECTION: SIREN will be collecting personal data about Participants when they enter the Contest. Please review SIREN’s privacy policy statement at http://www.sirensolar.org/Privacy.htm. By participating in the Contest, Entrants hereby agree to all of the terms and conditions of the privacy statement of SIREN. LIST OF PRIZE WINNERS: For a copy of the list of prize winners, you can send a send a self-addressed stamped envelope to: 2010 SIREN Energy Showdown Contest List of Prize Winners, 323 South Walnut Street, Bloomington, Indiana 47401, within [90 DAYS AFTER CONTEST END DATE]; but we would prefer that you visit www.sirensolar.org on or after January 1, 2011 instead.
